The Justice family filed the amended complaint in Greenbrier County Circuit Court, alleging that TRT Holdings—parent company of Omni Hotels & Resorts—colluded with Carter Bank & Trust to seize control of the property through what they characterize as an unlawful conspiracy. According to the lawsuit, the defendants violated antitrust laws and misused confidential financial information to undermine the family's efforts to refinance or retire roughly $300 million in debt.
The family's legal team, led by attorney Steve Ruby, seeks at least $500 million in damages. The complaint alleges that TRT Holdings, which operates the rival Omni Homestead Resort 40 miles away in Virginia, intended to eliminate competition by acquiring The Greenbrier and replacing its workforce with staff transferred from the Homestead property.
TRT Holdings has moved to dismiss the claims, characterizing them as unfounded. In federal filings, the company's subsidiary, White Sulphur Springs Holdings LLC, has petitioned the U.S. District Court for the Southern District of West Virginia to appoint an emergency receiver to oversee the resort's operations. In documents filed May 3, attorneys for the subsidiary leveled counteraccusations, claiming the Justice family has "looted" resort revenue since 2018. The filings allege that nearly all operating cash flow—totaling hundreds of millions of dollars—has been diverted to other Justice-owned businesses and personal expenditures, including aircraft.
WSSH attorneys argue the family has defaulted on more than $141 million in debt and allowed the 250-year-old landmark to deteriorate, citing unmaintained grounds and peeling paint. The company asserts that owners have failed to remain current on taxes, health insurance premiums, and retirement contributions for approximately 2,000 employees.
The underlying dispute traces back years of tension between the Justice family and Carter Bank, which held the resort's primary loans for over two decades. The bank filed dozens of "confessions of judgment" against the family beginning in 2023 after they missed repayment obligations. Court records indicate that TRT Holdings subsequently purchased the Greenbrier debt from Carter Bank. While the Justices claim the bank deliberately blocked their payoff proposals to facilitate a covert sale, TRT maintains the family received 14 separate forbearance agreements and failed to remit payment despite receiving wire instructions.
Chief U.S. District Judge Frank W. Volk has scheduled an evidentiary hearing on the receivership request for June 8, 2026. Justice, who acquired the resort from bankruptcy in 2009, remains the majority owner, though his daughter, Jill Justice, oversees daily operations.
