Joe Biden has initiated legal action against the Department of Justice to stop the disclosure of audio recordings and transcripts from his interviews connected to a special counsel investigation into his handling of classified documents. The lawsuit highlights concerns over privacy and government transparency amid intense political scrutiny.
The recordings and transcripts in question stem from interviews Biden gave at his home in 2016 and 2017 with the ghostwriter Mark Zwonitzer during work on Biden’s memoirs. These materials were obtained by special counsel Robert Hur during his probe into Biden’s retention of classified documents from his tenure as senator and vice president.
Biden’s legal team argues that releasing these private conversations would constitute a significant invasion of personal privacy, especially since the Justice Department acquired the information through a criminal investigation. According to the suit, all Americans, including former officials, deserve protection of their private communications obtained under such circumstances.
The Department of Justice had planned to share the files with both Congress and the conservative Heritage Foundation, despite previous assertions that the materials were exempt from disclosure under federal public records laws. Biden’s lawsuit seeks to prevent this dissemination.
Special counsel Hur’s investigation produced a comprehensive report raising questions about Biden’s age-related cognitive competence but ultimately recommended no criminal charges due to insufficient evidence for prosecution. This investigation unfolded alongside efforts by Biden to block release of related interview audio directly tied to the probe. The controversy has already prompted the House to vote on holding the former Attorney General in contempt for refusing to comply with certain congressional demands for documents.
On social media, former President Donald Trump criticized Biden’s lawsuit against the DOJ, branding him a “Crooked Politician” while drawing attention to the ongoing conflict over transparency and accountability in the handling of classified information between the two leaders.
